BY USING THE SWEETPHP SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE SOFTWARE. NOTICE: SweetPHP licenses the enclosed software to you only upon the condition that you accept all of the terms contained in this license agreement. If you do not agree to these terms and conditions, then SweetPHP is unwilling to license the software to you, in which case you should not use the software and remove the software from your system. This is an agreement between Licensor and Licensee, who is being licensed to use the Software. 2. Licensee acknowledges that this is only a limited nonexclusive license. Licensor is and remains the owner of all titles, rights, and interests in the Software. 3. This License permits Licensee to install the Software on one server to be used with only one domain or internet address. Licensee may make copies of the Software for backup purposes only. 4. WARRANTY DISCLAIMER: SweetPHP makes no representations or warranties about the suitability of this software for any purpose. The software is provided "as is"; without express or implied warranties, including warranties of merchantability and fitness for a particular purpose or non infringement. SweetPHP shall not be liable under any theory or any damages suffered by you or any user of the software. 5. DISCLAIMER OF DAMAGES: Regardless of whether any remedy set forth herein fails of its essential purpose, in no event will SweetPHP be liable to you for any special, consequential, indirect or similar damages, including any lost profits or lost data arising out of the use or inability to use the software even if SweetPHP has been advised of the possibility of such damages. Licensee agrees to defend and indemnify Licensor and hold Licensor harmless from all claims, losses, damages, complaints, or expenses connected with or resulting from Licensee's business operations. 6. TERMINATION: SweetPHP may terminate the right to use the Software on notice to you (which may be delivered electronically or by the same means as this Software is distributed), and you may terminate this license at any time by destroying or erasing your copy of the Software. Upon the termination of this license, you must discontinue all use of the Software and remove the Software from your system. SweetPHP reserves the right at any time to cease the support of the Software and to alter prices, features, specifications, capabilities, functions, licensing terms, release dates, general availability or other characteristics of the Software. 7. This License Agreement is the entire and exclusive agreement between Licensor and Licensee regarding this Software. This License Agreement replaces and supersedes all prior negotiations, dealings, and agreements between Licensor and Licensee regarding this Software. 8. This License Agreement is governed by the law of Connecticut applicable to Connecticut contracts. 9. This License Agreement is valid without Licensor's signature. It becomes effective upon the earlier of Licensee's signature or Licensee's use of the Software.
